Terms of Service

Effective date: 25 September 2026, except that three changes take effect on 10 October 2026 for anyone who accepted an earlier version (listed below). This replaces the terms dated 23 August 2026.

What changed on 25 September 2026: section 3 now describes Ultra as a plan that includes everything in Pro, states plainly that Pro and Ultra renew every year until you cancel, and says how to cancel; the Founding-member renewal price is no longer offered (founder keys already issued keep working for the term they carry); section 4c describes the optional automatic driver install, and that NVIDIA drivers are reported rather than installed; section 4g now covers direct reads of NTFS, FAT32 and exFAT drives and Windows' point-in-time copies, as well as the Recycle Bin; and section 2 says how to get the list of open-source components the app ships with. Most of these only describe how the product and our checkout already work, and apply from 25 September 2026. Three are material changes, so for anyone who accepted an earlier version they take effect on 10 October 2026, 15 days after this notice, as section 11 provides: the end of the Founding-member renewal price; what you accept by switching on automatic driver installs (section 4c); and the facts you accept when Deleted File Restore reads a drive directly or reads Windows' point-in-time copies (section 4g).

1. Who you're agreeing with

These terms are a contract between you and ARHAS INDIA (OPC) PRIVATE LIMITED, a One Person Company incorporated under the Companies Act 2013 (CIN: U62013TS2026OPC220112), registered office SY No. 4A & 4/AA, Peeramcheru, Golconda, Hyderabad 500008, Telangana, India ("we", "us", "the Company"). BRUTAL Optimizer is the product name; ARHAS INDIA (OPC) PRIVATE LIMITED is the legal party. Contact: legal@brutaloptimizer.com.

By downloading, installing, or using BRUTAL Optimizer ("the app"), you agree to these terms. If you don't agree, don't install it — and if it's already installed, uninstall it. The in-app agreement you accept on first launch is part of these terms.

1a. Eligibility — you must be an adult to agree

You must be 18 years old (or the age of majority where you live, if higher) to accept these terms and to purchase a license. Under the Indian Contract Act, a minor cannot enter this contract — and the risk acknowledgments in section 4 only work if the person accepting them can legally accept them.

If you are under 18, you may use the app only if a parent or guardian installs it, accepts these terms and the section 4 risk acknowledgments on your behalf, and supervises your use. Purchases must be made by the parent or guardian. Our handling of minors' personal data, including verifiable parental consent under section 9 of the Digital Personal Data Protection Act 2023, is described in the Privacy Policy.

2. The license

The app is licensed, not sold. We grant you a limited, personal, non-exclusive, non-transferable license to install and use the app on Windows machines you own or control, for its intended purpose: optimizing your own PC.

You may not, except where the law expressly gives you the right despite this clause:

• reverse-engineer, decompile, or disassemble the app, or try to derive its source code or algorithms;
• modify, patch, or tamper with the app or its binaries, or create derivative works;
• circumvent, disable, or defeat licensing, activation, machine-binding, or update-verification mechanisms — these are technological protection measures, and defeating them is a material breach;
• remove or alter copyright, trademark, or other proprietary notices;
• redistribute, resell, rent, sublicense, or share the app, license keys, or any cracked, repackaged, re-signed, or modified copies.

Everything we made in the app — our code, design, interface, optimization modules, and brand — is our intellectual property, except for third-party and open-source components (including the .NET runtime and open-source libraries the app ships with), which remain their owners' property and are licensed under their own terms; we will send you the list of those components and their licences on request at support@brutaloptimizer.com. We reserve all rights and remedies in our own work, including injunctive relief and takedown notices against infringing copies.

3. Tiers, keys, and what happens when they end

• Free tier. Free to use, no account required — the app works without any activation. You can optionally sign in with your email (no password, no payment) to link a license or account. Most of the toolbox is free; Pro adds the deep automation and deep-tuning modules.
• Pro subscription (sub_ keys). A yearly paid license at ₹499/year, bought through Razorpay's web checkout. Prices may be displayed in your local currency for convenience, but all charges are processed in Indian Rupees (INR) through Razorpay; your bank's exchange rate and any foreign-transaction or conversion fees apply. One person, one machine at a time. You can move your license to a new PC yourself up to twice in any rolling 90-day period (email-verified unbind from your account page); beyond that, contact support — we help with genuine hardware changes.
• Ultra subscription. A yearly paid license at ₹899/year that includes everything in Pro, plus Smart Route — which routes your selected game's traffic through relay servers we operate, only when a measured test shows the relayed route is better (see section 4f). Ultra is bought through the same Razorpay web checkout as Pro, and the same INR-processing and one-machine rules apply. Smart Route is not included in Pro: measuring routes and viewing results is free for everyone; engaging a relay requires Ultra. It is a game-traffic relay, not a general-purpose VPN, and the relay fleet and the feature may change as described in section 12.
• Legacy promotional keys (found_). A small number of keys issued under a promotion that is now closed, bound to the email they were issued to. Same rules as Pro while active.
• Gift and giveaway keys (gift_). Pro keys we issue directly for gifts, giveaways, and promotions. Giveaway prizes are one year of Pro from activation, followed by the standard grace period; keys we issue individually as gifts may be lifetime, and the email that delivers your key states which you have. Non-transferable once activated.
• "Lifetime" means the product's lifetime. A lifetime key is valid for as long as we offer and operate BRUTAL Optimizer and its licensing service — not for your lifetime, and not forever regardless of what happens to the product. If we discontinue the product, lifetime keys end with it (see section 12). We say this plainly here so there is no surprise later.
• Renewal and grace. When a paid term ends, you get a 14-day grace period with reminders. After that, the app drops to the free tier — your applied optimizations and settings stay exactly as they were. Nothing is reverted or held hostage.
• Automatic yearly renewal, and how to cancel. Pro and Ultra renew automatically every year until you cancel. Each renewal is charged through Razorpay at your plan's price at the time it renews, and we email you a reminder 30, 7 and 1 days before your term ends. To cancel, email support@brutaloptimizer.com from your account email, or reply to any renewal reminder we send — either one is enough, and we confirm the cancellation by email. If your payment emails from Razorpay include a subscription-management link, you can use that too. Cancelling stops future charges; you keep the paid features until the end of the period you already paid for. Refunds of renewal charges — including the 7-day window for unwanted renewals — are governed by the Refund & Cancellation Policy (section 10).
• Don't share keys. Keys are for one person. Sharing, reselling, or publishing keys is a breach, and we may revoke keys involved in abuse or fraud (for example, keys bought with charged-back payments or minted by circumventing the claim system).

4. What the app actually does — read this before you rely on anything else

BRUTAL Optimizer is not a passive utility. Run as Administrator, it changes Windows itself: registry values, services, power plans, network parameters, boot configuration, driver installs, and file deletion. We build every change to be reversible where reversal is technically possible, we tell you what each change does before you apply it, and we take restore points before the big ones. The sections below describe each category of risk in plain language. Using each feature means you understood and accepted the risk described for it. This informed acceptance is a condition of the license.

4a. Registry and system modification

The optimization modules modify the Windows registry (HKLM and HKCU), services, scheduled behavior, power management, GPU and network configuration, memory management, timer resolution, USB/input settings, and boot configuration data. System-level changes can cause instability, crashes, boot problems, degraded performance, or incompatibility with other software — on some hardware and Windows configurations, in ways we cannot fully predict.

What we give you to manage that risk: per-module undo (the app captures the before-state of what it changes and can restore it), a system restore point before major changes, and honest per-module descriptions. Undo is best-effort: it restores what the app changed, but Windows updates, driver changes, or other software acting in between can mean a state is no longer perfectly restorable. We strongly recommend a full backup or restore point before applying optimizations. You are responsible for backing up your system; we are not liable for your failure to do so.

4b. Module 11 — disabling Windows security mitigations (Pro)

4c. Driver installation

The driver updater finds driver updates through Windows Update and the Microsoft Update Catalog, and installs the ones you choose through Windows itself. For NVIDIA graphics cards it checks NVIDIA's official driver service and tells you when a newer driver exists; you download and install that driver from NVIDIA yourself — the app reports it and does not install it. Drivers are the vendors' software, not ours: we don't author, modify, or warrant them. A driver install can fail, misbehave, or degrade your system — that is true of any driver install, from any tool. Before installing, the app creates a system restore point (best-effort — Windows can decline or rate-limit one). If a driver causes problems, use the restore point, Windows' driver rollback, or our driver-backup feature. We are not responsible for defects in third-party drivers or for vendor download services being unavailable.

Automatic driver installs happen only if you turn them on. By default the background check only detects, and you confirm each install. Pro includes an optional setting that installs driver updates automatically. If you switch it on, you choose its scope — graphics, network and input drivers only (the default), or all drivers Windows Update can install safely — and you accept that drivers in that scope will be installed without a per-install confirmation. Whatever scope you choose, firmware and BIOS updates, storage-controller drivers, vendor drivers that would replace a Windows generic driver, drivers Windows Update offers only as a manual download, and NVIDIA graphics drivers are never installed automatically. Automatic installs run only while you are away from the PC, not on battery, and never during or just after a game; the app takes one restore point per run when Windows allows one, re-reads each driver's version afterwards to confirm what actually changed, and notifies you when anything does. You can switch the setting off at any time.

4d. Disk cleaning and permanent deletion

The cleanup features delete files in two different ways, and the difference matters:

• The Disk Cleaner (junk categories) permanently deletes the categories you select — those files do not go to the Recycle Bin (recycling temp files wouldn't free space), and the app takes no copy of them first, so treat everything it clears as gone for good. Deleted File Restore does not soften that: it only lists and copies back files that an intact store on your own PC still holds, and a Disk Cleaner deletion leaves no such copy behind. It works only from a fixed allow-list of known-junk locations, age-gates fresh temp files, refuses protected paths, and reports the actual bytes freed — but the decision to delete is yours, made per category, and once deleted, deleted. Caution-marked categories (like the Windows Update cache) are off by default for a reason. Check what a category covers before you clean it.
• The Disk Analyzer and Install Residue (formerly "Clean Uninstall") move items to the Recycle Bin — recoverable until the Recycle Bin is emptied. Emptying the Recycle Bin (including via the cleaner's Recycle Bin category) is itself permanent.

We are not liable for loss of data you chose to delete.

4e. Game profiles, gaming optimizations, and anti-cheat

Game profiles and gaming optimizations change how Windows treats a game's process: CPU priority (IFEO), network QoS/DSCP marking, MMCSS scheduling, timer resolution, and similar system-side settings. The app is deliberately built to be anti-cheat-safe: no kernel driver, no code injection, no memory reading or writing of game processes, no DX hooks, no firmware tampering — the FPS counter and all tuning use documented, system-side Windows mechanisms only. We designed it to run alongside anti-cheat, not against it.

But the ban decision is never ours to make. Anti-cheat systems belong to game publishers, their policies change without notice, and some publishers prohibit any third-party "optimization" or system modification regardless of technique. We cannot and do not guarantee that any game, publisher, or anti-cheat system will permit the app's optimizations, and we are not liable for game account suspensions or bans, including permanent ones, or for lost in-game purchases, progress, or rankings. If a game's rules prohibit tools like this, don't use these features with that game — checking the game's rules is on you.

4f. Smart Route — relay routing (Ultra)

When you engage Smart Route, the app routes your selected game's traffic — and only that — through an encrypted WireGuard tunnel to a relay server we operate, and out to the game's server. Plain facts you accept by using it:

• Your game traffic exits from our IP addresses. That is how a relay works — and it is why relay conduct is governed by the Acceptable Use Policy (section 5). Route only your own game's traffic via the app; the relays are not a general-purpose VPN or proxy.
• Measure first, engage only if it wins, auto-revert. The app tests both routes and engages a relay only when the measured relayed route is better; if a relay stops helping or stops responding, the app reverts to your direct connection. Direct is always the fail-safe.
• No ping guarantee. A relay can reduce latency, jitter, or loss on some routes at some times — and do nothing on others. We show you the measurements; we don't promise numbers.
• The fleet changes. Relay locations may be added, moved, or removed, and individual relays or the whole service may be unavailable, degraded, changed or ended, as described in section 12. We may also disable Smart Route for a specific game via the safety catalog when we judge it unsafe.
• Anti-cheat. Section 4e applies fully: routing traffic through a relay is visible to game networks as a changed network path, some publishers restrict VPN-like tools, and the ban decision is never ours. We are not liable for suspensions or bans.

4g. Deleted File Restore — what it can and cannot get back

Deleted File Restore lists deleted files it has read and checked — from your Recycle Bin, from a direct read of a drive you choose (NTFS, FAT32 and exFAT: internal drives, memory cards and USB drives), and from the point-in-time copies Windows keeps of your drives (shadow copies, the same thing behind "Previous Versions") — and copies them somewhere you choose. Plain facts you accept by using it:

• Nothing is listed on the strength of a record alone. On a direct drive read it does read the filesystem's own records of deleted files — but it then reads the blocks each record points at, and only what reads back as real data is offered. Where a file format stores checksums of its own, those are recomputed. This matters because a record routinely outlives the file it describes: a tool that trusts one without reading behind it shows you a real name, a real size and a file of zeros.
• What it does not do. It does not assemble a file out of fragments in free space. Point-in-time copies are only ever read — it never creates, deletes or resizes one — and a copy can only help if Windows took it while your file still existed. If nothing survives that it can read, nothing is listed: "we found nothing" is the ordinary answer, not a failure.
• Internal SSDs are usually beyond reach, and that is not a limitation of this software. Windows tells an SSD to discard a deleted file's blocks almost immediately, and once the drive has done that the data is gone — no product recovers it, whatever it claims. Memory cards and USB drives generally never receive that instruction, which is why they are where a direct drive read works best. Files we find but cannot return are listed anyway, with the reason, rather than quietly omitted.
• It never deletes anything, and never runs on its own. It empties nothing and is never triggered by Guardian, Boost, Smart Optimize, Extreme Mode or the one-click tune-up. You start it, you pick the rows, you pick the destination.
• It refuses to restore onto the drive it read from, judged by the physical disk rather than the drive letter, because two letters can share one disk. Writing to the same media can overwrite the very thing you are trying to get back — which is also why, if you have just lost something important, you should stop writing to that drive, including by installing software, including ours.
• Reading a drive directly requires administrator rights, and is read-only. Scanning a drive opens it for reading and nothing else; the app has no write path to it at all. Scan drives you own or are authorised to examine.
• Shared PCs. From the Recycle Bin it opens only the bin belonging to the Windows account you are signed in to; it will tell you how many other accounts on this PC have deleted files, and nothing else about them. A direct drive read is different: it reads the drive's own file table, which covers the deleted files of every account that used that drive. Use it on machines you own or are authorised to administer.
• It reads; we receive nothing. Filenames, paths and file contents are read on your PC and never leave it — not uploaded, not written to any log that could ride along inside a crash report, and never seen by us in any form.

5. Acceptable use — and your responsibility for it

Don't use the app to break the law, attack or interfere with other people's systems, or cheat: the app must not be used to circumvent anti-cheat, DRM, or any technical protection of someone else's software. Don't use it on machines you don't own or lack authority to administer.

It applies to everything you do with the app and your keys, and expressly extends to all traffic you send through Smart Route relays (section 4f) — because that traffic exits from our IP addresses, unlawful relay traffic is a breach of these terms, not just bad manners.

You agree to indemnify us — cover our losses, including reasonable legal costs — against third-party claims that arise from your breach of these terms or the Acceptable Use Policy, your violation of law, your misuse of the app, or traffic you send through our relays. This doesn't apply to the extent a claim is caused by our own fault.

6. Warranties — what we promise and what we can't

We promise honest behavior, precisely scoped: the in-app description of each optimization module accurately states what the module modifies, the app discloses what it changes, and it includes the undo and restore mechanisms described above. That is the promise. Performance outcomes described anywhere — in the app, on the website, in blog posts or store listings (e.g. estimated RAM freed or FPS gains) — are estimates based on typical configurations, not warranties; your results depend on your hardware and software. Beyond the scoped promise above, the app is provided "as is" and "as available", without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement — to the extent the law allows those to be excluded. We don't warrant that the app is error-free, that optimizations will improve performance on your specific hardware, or that it will be uninterrupted. Nothing in this section limits warranties or guarantees that Indian law does not allow us to exclude, including your non-excludable rights under consumer protection law.

7. Limitation of liability

To the maximum extent permitted by applicable law:

• Cap. Our total aggregate liability for all claims arising out of or relating to the app or these terms is limited to the greater of (i) the amounts you paid us for the app in the 12 months before the event giving rise to the claim and (ii) ₹500. That ₹500 floor applies to everyone — free users, lifetime key holders and subscribers alike — so no one's cap is ever zero.
• Excluded losses. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, loss of profits or revenue, business interruption, hardware degradation attributed to changed settings, game account bans or in-game losses, or the cost of substitute software — even if we were advised such losses were possible, and regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise).
• What is never limited. Nothing in these terms excludes or limits liability for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, for death or personal injury caused by our negligence, or for anything else that applicable law does not permit to be excluded or limited — including rights you hold under the Consumer Protection Act 2019 that cannot be waived. We say this expressly: where the law overrides a clause above, the law wins and the rest of the clause still stands.

8. Your data

The app works locally; what little it sends over the network is itemized, every call, in the Privacy Policy. Personal data (your email address and license record) is handled in accordance with the Digital Personal Data Protection Act 2023. The Privacy Policy is part of how we operate but is a separate document — it describes practices; these terms are the contract.

9. Termination

• By you: any time — uninstall the app. If you want your account data deleted too, email us (see the Privacy Policy).
• By us: we may suspend or revoke a license, or terminate this agreement, if you materially breach these terms (key sharing/resale, circumvention, payment fraud or chargebacks, unlawful use). Where practical we'll warn you first; for fraud or circumvention we may act immediately.
• On expiry (not termination): a lapsed Pro term is not a termination — the app simply drops to the free tier with your settings intact, as described in section 3.
• Survival: sections that by their nature should survive do survive — including intellectual property (2), assumption of risk (4), indemnity (5), warranty disclaimer (6), limitation of liability (7), and disputes (13).

10. Refunds

Payments run through Razorpay. Statutory refund and cancellation rights under Indian consumer law are not affected by anything in these terms. Refunds and cancellation are governed by our Refund & Cancellation Policy at brutaloptimizer.com/refund, which forms part of these Terms — including how your purchase is delivered, the 7-day first-purchase refund and the accidental-renewal grace window.

11. Changes to these terms

We may update these terms. For material changes we will give notice — on this page with an updated effective date, and in the app (which presents updated terms on the next launch after a change). Material changes take effect no sooner than 15 days after notice, unless a change is required by law or addresses a security or abuse issue, in which case it may take effect immediately. If you don't agree with a change, stop using the app before it takes effect; continued use after the effective date means you accept the updated terms.

12. Changes to the product — including safety switches

We may add, change, or remove features, and may ultimately discontinue the product. In particular, we may operate safety and integrity mechanisms — remotely disabling a feature, module, or game-catalog entry when we judge it unsafe (for example, when an anti-cheat or Windows change makes an optimization risky). These can reduce functionality without notice, and we are not liable for feature changes or removals made in good faith. If we discontinue the product entirely, we will give reasonable notice where practicable, and paid subscribers with unused prepaid time will receive a pro-rata refund of that unused time — that commitment is stated in the Refund & Cancellation Policy too, and it is what makes the lifetime definition fair: lifetime keys are defined by the product's lifetime (section 3) and do not create an obligation to operate the product indefinitely, but nobody who prepaid for time we didn't deliver is left holding the bag.

13. Governing law and disputes

These terms are governed by the laws of India.

• Talk to us first. Most problems are fixable in one email: legal@brutaloptimizer.com. We ask (but don't require) that you give us 30 days to resolve a dispute before formal proceedings.
• Arbitration. Subject to the consumer carve-out below, disputes arising out of or in connection with these terms shall be referred to arbitration under the Arbitration and Conciliation Act 1996, by a sole arbitrator, seat and venue Hyderabad, proceedings in English. Subject to the consumer carve-out below, courts at Hyderabad have exclusive jurisdiction over matters not subject to arbitration, including interim relief.
• Consumer carve-out. If you are a consumer under the Consumer Protection Act 2019, nothing in these terms takes away your right to bring a complaint before the consumer dispute redressal fora (District, State, or National Commission) having jurisdiction. The arbitration clause does not apply to disputes you are entitled to bring, and choose to bring, in a consumer forum.

14. General

• Severability. If any provision is unenforceable, it is limited or removed to the minimum extent necessary and the rest stays in force.
• Force majeure. We're not liable for delay or failure caused by events beyond our reasonable control (including outages of third-party infrastructure we depend on, natural disasters, war, or government action).
• Assignment. You may not assign these terms. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of the business, with notice to you.
• No waiver. Not enforcing a provision once doesn't waive it.
• Entire agreement. These terms, together with the in-app agreement, the Privacy Policy, the Refund & Cancellation Policy, and the Acceptable Use Policy, are the entire agreement between you and us about the app, and supersede the June 2026 terms and any prior understandings.
• Third-party services. Windows Update, NVIDIA's driver service, DNS providers, Razorpay, and other third-party services the app interacts with are governed by their own terms; we're not responsible for their availability or policies.
