BRUTAL Optimizer for Android — Terms of Service

These terms cover BRUTAL Optimizer for Android and the relay service it uses; our Privacy Policy for Android explains what data we handle. BRUTAL Optimizer for Windows is a different product with its own terms, published with that product.

1. Who you're dealing with

BRUTAL Optimizer is a product of ARHAS INDIA (OPC) PRIVATE LIMITED, a One Person Company incorporated in India under the Companies Act 2013, registered office at Hyderabad ("we", "us", "the Company"). Contact: legal@brutaloptimizer.com. These terms are a binding agreement between you and the Company.

2. The service

BRUTAL Optimizer routes your selected mobile game's traffic through a relay server in your region over a VPN tunnel established on your device, and shows you real, measured connection numbers. The tunnel carries the selected game's IPv4 traffic only; any IPv6 the game uses travels over your normal connection. BRUTAL Optimizer is a connection tool: it does not modify games, inject code, read game memory, or interfere with anti-cheat software.

Two details sit inside the phrase "routes your game", and we would rather you read them here than discover them: while a game is routed, all of that game's IPv4 traffic goes over the relay — not only the match server, but every IPv4 host that app talks to — and the tunnel sets 1.1.1.1 (Cloudflare's public resolver) as that game's DNS server, so its name lookups resolve inside the tunnel rather than beside it. Both apply to the one game you selected and to nothing else on your phone: no other app's traffic enters the tunnel, and your phone's normal resolver is untouched for everything else and restored for that game the moment you disconnect. Our Privacy Policy explains what this means for your data.

3. Honest limits — read this

• Measured, not promised. BRUTAL Optimizer shows the numbers it measures. A relay can genuinely help, do nothing, or on a good network be unnecessary — staying on your direct line is a normal outcome. We never promise an FPS or ping improvement.
• Game rules are yours to follow. Section 4 covers this in full. Short version: routing a game's traffic may sit uneasily with that game's terms, and the risk of a publisher's response is yours.
• Availability. Relays are provided "as available". If a relay degrades or dies, the app's fail-safe returns your game to its direct connection — that is by design.
• Coverage is not everywhere. The app is available worldwide; the relay fleet is not. We run relays in regions such as India (Chennai, Mumbai, Bangalore, Delhi), Singapore, Jakarta, Tokyo, Seoul, Frankfurt, Dallas, São Paulo and Bahrain — and because the ban-safety rule in Section 4 lets us route you only through a relay in your own region, a player in a region we do not cover gets no route from us at all. There is no relay in Oceania or Africa today. If you are in a region we don't cover, the app tells you so and leaves you on your direct connection, and Ultra does not change that — a subscription cannot buy a relay that does not exist. Regions can be added or retired at any time (Section 8), so check before you buy for a region not named above.

4. Game bans — an informed choice, and it's yours

This is the most important section in these terms. Read it before you connect.

• The risk, plainly. Some game publishers prohibit or restrict VPNs, proxies, or datacenter IPs in their terms of service. Using BRUTAL Optimizer with such a game could — even though BRUTAL Optimizer never touches the game itself — be treated by the publisher as a violation, and could result in warnings, restrictions, suspension, or a permanent ban of your game account.
• What we do to reduce it. We route you only through relays in your own region, so a connection is not region-hopping and is designed not to look like it — though we cannot control how any publisher's detection systems classify a datacenter IP. We keep a per-title ban-safety catalog that disables routing for games whose anti-cheat is known to flag datacenter IPs, and we operate remote kill switches: when we flip one, new connections to that title are blocked immediately, and a session already running is cut off at its next server check — typically within about 15 minutes — after which your game falls back to its direct connection. For BGMI, the app is additionally locked to the Indian market. These measures reduce risk; nothing eliminates it. The catalog and kill switches are best-effort safety measures based on information available to us; they can lag behind a publisher's changes, and a title being enabled is not a representation that routing it is safe.
• What we can't do. We can't control what a game publisher decides, can't guarantee any game's tolerance of VPN-routed connections, and can't restore a banned game account. Publishers' rules change without notice.
• YOUR CHOICE, YOUR RISK. By connecting a game through BRUTAL Optimizer you confirm you understand the above and accept the risk of any action a game publisher takes against your game account. Complying with the terms of the games you play is your responsibility, not ours.

5. Your account, your age

You sign in with your email (a one-time code — no password) or with Google. Depending on the build you installed, Discord and Sign in with Apple may also be offered; each appears only when that provider is configured into that build, so a sign-in method you can see is one that works. Whichever you use, your email is your account identity — keep access to it. Your account has a device cap; you can manage and remove devices in the app.

You must be 18 or older to use BRUTAL Optimizer. The service is not offered to, and not directed at, anyone under 18. We do not knowingly maintain an account for someone under 18, and we delete one if we learn of it.

The reason is simple: India's Digital Personal Data Protection Act 2023 treats everyone under 18 as a child, and the free plan is funded by advertising that uses your device's advertising ID. So we set the age at 18 and keep it there. We ask you for no age and store none, and every ad request on the free plan is non-personalized and capped at the mildest content rating Google offers — for every user, as a matter of course. Our Privacy Policy states the same 18+ position.

6. Free tier and BRUTAL Optimizer Ultra

• Free: boosts are gated by a short rewarded ad (Google AdMob) that funds the relay network. Where the law requires it (for example the EEA/UK), the app shows Google's consent form (UMP) before any ad is requested; if you don't consent, the app requests no ads at all — and your boosts still work; declining consent never locks you out of the free tier. Free capacity can be limited or paused when relays are full — free access is a courtesy, not an entitlement.
• Ultra: a paid subscription that removes ads, keeps a share of relay capacity for subscribers, and covers your desktop and phone on one plan. In this Android app, Ultra is sold through Google Play's billing system and nowhere else. Google shows you the plans and the price before you buy, in the currency of your Google Play account, and Google Play's own cancellation and refund mechanics apply — see Section 9. An Ultra subscription you already hold from BRUTAL Optimizer for Windows also unlocks Ultra here when you sign in with the same email; it stays billed, renewed and refunded by whoever sold it to you, under the terms published with that product. If Google Play Billing is unavailable on your device — which is the case for a copy of this app that did not come from Google Play — Ultra cannot be purchased in the app at all, and the app tells you so rather than sending you elsewhere. Subscriptions renew automatically until cancelled; cancel anytime with the provider you bought from and access continues to the end of the paid period. Renewal notices come from whoever bills you: for a subscription bought in this app that is Google Play, which sends its own receipts and renewal reminders; for a desktop subscription we email you before each renewal charge. Refunds are governed by our Refund & Cancellation Policy for Android: on your first paid purchase you can get a full refund for any reason within 7 days of the charge, no interrogation; if an auto-renewal catches you by surprise, the same policy gives you an accidental-renewal grace window. If we discontinue Ultra while you have paid time remaining, we'll refund the unused portion. A refund follows the policy of the channel you bought through: the Refund & Cancellation Policy for Android for a purchase made in this app through Google Play, and the policy published with BRUTAL Optimizer for Windows for a purchase made there. Use of BRUTAL Optimizer for Windows itself remains governed by its own terms.
• "Lifetime" access, where we ever grant it (for example promotional keys), means the lifetime of the BRUTAL Optimizer product — for as long as we operate the service — not the lifetime of the purchaser.

7. Acceptable use — and what happens if you abuse our relays

BRUTAL Optimizer relays carry your traffic under our IP addresses. That is a trust we extend to you, and these rules protect it:

• Use relays only for your own game traffic through the app. No reselling or sharing relay access.
• No unlawful activity of any kind through the service — no attacks, no fraud, no infringement, nothing that violates the law where you are or where our relays are.
• No attempting to overload, probe, reverse-engineer, or break the relays, control plane, ad gate, or entitlement checks.

If unlawful or abusive traffic passes through our relay IPs because of your use, that is your liability, not ours. You agree to indemnify the Company — that is, cover our losses, costs, and reasonable legal fees — against third-party claims, regulatory action, or damage arising from your breach of this section or your unlawful use of the service. We may suspend or terminate your access immediately for abuse, and we will cooperate with lawful orders from courts and authorities, which can include disclosing the connection metadata described in our Privacy Policy.

8. The service will change — including safety shutdowns

We actively operate this service, and that means changing it:

• We may add, move, or retire relay servers and regions at any time.
• We may add or remove games from the routing catalog, and we may use the per-title kill switch when we judge the ban risk or a technical issue warrants it: new connections to that title are blocked immediately, and a session already running is cut off at its next server check — typically within about 15 minutes — after which your game falls back to its direct connection.
• If your main game is permanently removed: where routing for a title is permanently disabled (not a temporary safety pause) and it was your account's primary routed game, we offer a pro-rata refund or credit of the remaining paid period on request. Temporary and safety pauses are part of operating the service and are not compensable.
• We may modify or discontinue features, tiers, or the service itself. If we discontinue the product entirely, paid users get the unused portion of their subscription refunded (Section 6); beyond that, changes made in good faith to operate or protect the service don't give rise to liability.

9. Google Play distribution

BRUTAL Optimizer for Android is distributed through Google Play. For copies obtained there: Google is not a party to these terms and has no obligations to you under them; where Google Play's own policies or Google Play Billing terms apply to a purchase or to the app, those policies prevail over the conflicting part of these terms (including billing, cancellation, and refund mechanics for purchases made through Play); and any rights Google requires app distributors to grant users are granted.

A copy of this app obtained anywhere other than Google Play (a direct download) cannot use Google Play Billing, so Ultra cannot be purchased inside it at all — the app says so rather than offering you another way to pay. An Ultra subscription bought elsewhere still works in it once you sign in.

10. Termination

You can stop using BRUTAL Optimizer anytime and delete your account in the app (Profile → Delete account). You can also request deletion without the app at legal@brutaloptimizer.com. We may suspend or terminate an account for breach of these terms (especially Section 7), non-payment, or legal necessity, or terminate the service on discontinuation (Section 8). Sections 4, 5 (responsibility for use), 6 (refund obligations), 7, and 11–14 survive termination.

11. Disclaimers and limits of liability

The service is provided "as is" and "as available", without warranties of any kind, express or implied — including fitness for a particular purpose or that it will improve your connection.

To the maximum extent permitted by law:

• We are not liable for indirect or consequential damages — including lost data, lost profits, in-game outcomes, lost matches, lost in-game purchases or progress, or account actions taken by a game publisher (Section 4).
• Our total liability for all claims arising from the service is limited to the amount you paid us in the 12 months before the claim — or ₹500 if you paid nothing.

What we don't limit. Nothing in these terms excludes or limits liability for fraud, gross negligence, wilful misconduct, death or personal injury caused by our negligence, or any right you have under law that cannot be waived — including your rights under Indian consumer-protection law. We say this expressly because it's true, and because terms that pretend otherwise deserve the skepticism they get.

12. Disputes — talk to us first

These terms are governed by the laws of India.

• Step one, always: email legal@brutaloptimizer.com. We answer, and we'd rather fix a problem than argue about it.
• If that fails: disputes will be resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by mutual agreement of the parties — and if we can't agree within 30 days, appointed by the court under Section 11 of that Act. The seat is Hyderabad and the language is English, but for claims under ₹5,00,000 either party may require the proceedings to be conducted by video conference or on documents only, so you never have to travel to press a claim. Subject to that, the courts at Hyderabad have exclusive jurisdiction.
• Consumer rights carve-out: if you are a consumer in India, nothing in this section takes away your right to approach the consumer dispute redressal fora under the Consumer Protection Act, 2019. That route stays open to you regardless of the arbitration clause.

13. Changes to these terms

We may update these terms. For material changes we'll update this page with a new effective date and give notice in the app before the change applies to you. Continuing to use the app after that notice means you accept the updated terms; if you don't, stop using the app and (if you're on Ultra) cancel — your existing paid period is honoured.

14. The boring-but-necessary part

• Severability. If any part of these terms is held unenforceable, the rest stands, and the unenforceable part is read down to the minimum extent needed.
• Force majeure. We're not liable for failures caused by events beyond our reasonable control (outages of upstream providers, government action, natural disasters, and the like).
• Assignment. You can't transfer your account or these terms to someone else. We may assign these terms as part of a corporate restructuring, merger, or sale of the product — your rights under them travel intact.
• Entire agreement. These terms — together with the BRUTAL Optimizer Privacy Policy, the Refund & Cancellation Policy for Android, and the Acceptable Use Policy for Android, each of which is incorporated into these terms by reference — are the whole agreement between you and us for BRUTAL Optimizer. If these terms and the Refund & Cancellation Policy for Android ever conflict on a refund question, the Refund & Cancellation Policy for Android prevails. No waiver of any term is a waiver of the term itself going forward.
